Is it Legal to Throttle Bandwidth?

An Internet Service Provider (ISP) is legally permitted to throttle bandwidth as a measure to prevent network congestion. The no-throttling provision in the FCC's open-internet rules prohibits ISPs from selectively throttling bandwidth based on content, applications, services, or non-harmful devices. Additionally, ISPs are required to transparently disclose any such throttling practices. While the FCC's net neutrality rules previously banned throttling, a change in 2018 allowed ISPs to legally throttle bandwidth for network congestion purposes, provided they openly disclose this practice.
